Terms
1. Scope
These terms govern the contract between you and Simois Weber, Schwarzkreuzweg 12, 5280 Braunau am Inn, Austria (“we”), for the easyTEPAI filing service. We are a private intermediary — we are neither AADE nor the creditor of the TEPAI tax itself.
2. Our service
We calculate your TEPAI according to the published Greek rates, collect the TEPAI amount plus our service fee (both itemized before you pay), file your TEPAI on the official AADE eTEPAI platform, and email you the confirmation — usually within 1–2 business days after payment.
3. Prices and payment
The total shown at checkout consists of the TEPAI amount set by Greek law and our service fee. We are a small business under the Austrian Kleinunternehmerregelung (§ 6 (1) 27 UStG), so no VAT is added to our fee. Payment is made by card via Stripe. The contract is concluded when your payment is completed.
4. Your mandate
By placing your order you instruct and authorise us to submit the TEPAI application to AADE in your name and on your behalf, using the data you supplied, and to pay the resulting e-Παράβολο payment code with the funds you provided. We act as your representative: you remain the person liable for TEPAI under art. 52 par. 6 of Greek law 5177/2025 (where there is more than one liable person — owner, holder or user — each is liable for the whole). We never enter our own details as the liable person. We record the date, the version of these terms and the IP address of your order as evidence of this mandate.
5. Your obligations
Enter the vessel and owner details exactly as they appear in the ship's registration documents — we file the TEPAI exactly as you entered it, and we do not add to or infer anything you did not state. TEPAI is due in advance, before entering Greek waters or before the month starts; ordering in time is your responsibility. Where the vessel's owner is not you, you confirm you are entitled to give us that person's details for this purpose.
Greece does not refund TEPAI once it has been paid (art. 52 par. 5(a) of law 5177/2025). A wrong length, a wrong month or a wrong year therefore cannot be recovered from the Greek State, and the loss is yours — please check your entries before paying.
6. Right of withdrawal
As a consumer you have a 14-day right of withdrawal for distance contracts under the Austrian Fern- und Auswärtsgeschäfte-Gesetz (FAGG, transposing Directive 2011/83/EU). By placing your order you expressly request that we begin performing the service before that period expires (§ 10 FAGG), and you acknowledge that your right of withdrawal lapses once we have filed your TEPAI in full (§ 18 (1) 1 FAGG). Until the filing has been made, you can cancel by emailing support@easytepai.com and we will refund your payment.
7. Liability
For damage other than personal injury we are liable only in cases of intent or gross negligence. We are not liable for decisions of Greek authorities, or for fines or other consequences caused by late ordering or by incorrect data you provided.
8. Governing law and disputes
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods; if you are a consumer, the mandatory consumer protections of your country of residence remain unaffected. Between businesses, the courts of Braunau am Inn, Austria have jurisdiction. If you are a consumer, the jurisdiction rules of Regulation (EU) 1215/2012 apply instead: you may sue us in the courts of your country of residence, and we may sue you only there.
Consumers may also bring out-of-court disputes before the Internet Ombudsstelle (ombudsstelle.at), an accredited Austrian consumer dispute resolution body. We are not obliged to participate in such proceedings, but we are willing to.
